Terms of service

"Kafu" is a platform provided by Kafu Technologies (Saudi limited liability company, Commercial Registration No. [CR-PENDING]) that enables users to build surveys and market research, target a verified KSA + GCC panel, and analyze results with AI assistance. Features evolve continuously; the current scope is described on the plans & pricing page.

• You must be 18 or older to create an individual account.
• For paid business accounts: a valid Commercial Registration and verified business address are required. For government and quasi-government entities, the official registration number substitutes for the CR.
• You are responsible for the accuracy of your account data, for password security, and for any activity under your account. Notify us immediately of any suspected unauthorized access.
• You may not create multiple accounts to circumvent free-tier limits, nor share login credentials with parties outside your organization.

Kafu may not be used for any activity that violates KSA law, including but not limited to:

• Violation of anti-money-laundering (AML) or counter-financing of terrorism (CFT) regulations.
• Publishing content that violates the Anti-Cyber Crime Law, the Anti-Terrorism Law, or KSA public morality regulations.
• Infringing third-party intellectual property rights.
• Sending unsolicited messages (spam) or collecting personal data without a valid legal basis.
• Attempting to compromise the platform, bypass security controls, or conduct penetration testing without prior written authorization from our security team.
• Using AI to generate fraudulent content, impersonate individuals, or deceive survey respondents.
• Scraping the verified panel through any automated means outside the authorized product interface.

• You retain full intellectual property rights to the content you input into the platform (survey questions, private analyses, data).
• You grant Kafu a non-exclusive, purpose-limited license to use your content within the platform to deliver the service to you (running the survey, storing it, displaying it to you, generating analyses on request).
• Kafu retains all rights to the platform itself: code, design, brand, algorithms, and pre-built templates.
• Aggregated, de-identified data used to improve the product (usage statistics, performance metrics) remains the property of Kafu.

• Prices are in Saudi Riyal (SAR) and include VAT (15%).
• Paid subscriptions auto-renew at the end of each term. You may cancel auto-renewal from billing settings at any time before the renewal date.
• AI tokens are metered on actual usage. You can set a maximum spend cap for your tenant.
• Tax invoices are issued under ZATCA e-invoicing rules and emailed on issuance.
• Refunds: monthly plans are non-refundable on partial-period cancellation. For annual plans, a full refund is available within the first 14 days without reason.
• If payment is overdue by more than 14 days we may suspend the account until settlement, with a grace period for you to export your data.

• You may terminate your subscription at any time from billing settings; access continues until the end of the paid period.
• We may suspend or terminate your account upon material breach of these terms, or under court order or competent-authority request. We notify you in advance when legally permitted.
• Post-termination: you have a 30-day window to export your data. After that, it is deleted per the retention schedule in the Privacy Policy (excluding data we are legally required to retain).

The platform is provided "as is", without implied warranties of fitness for a particular purpose. Kafu is not liable for indirect damages, lost profits, or data loss caused by the user's failure to meet their responsibilities (e.g. not enabling 2FA, sharing credentials).

Our cumulative maximum liability for any claim arising from your use of the platform shall not exceed the total fees paid to us during the 12 months preceding the claim.

This cap does not limit our liability for: fraud or gross negligence on our part, or any liability that may not be limited under applicable law.

You agree to indemnify Kafu and its personnel against any legal claim arising from: survey content you published, your breach of these terms, your infringement of a third party's rights, or your use of the platform in unlawful activity.

Kafu is not liable for any delay or failure of service caused by events beyond its reasonable control: internet infrastructure outages, natural disasters, war, acts of public authority, or pandemics.

These terms are governed exclusively by the laws of the Kingdom of Saudi Arabia. The Commercial Courts in Riyadh have exclusive jurisdiction over any dispute arising from or relating to your use of the platform, without resort to conflict-of-laws rules.

The parties may agree to arbitration under the Saudi Arbitration Law in lieu of court proceedings, by a separate written agreement made after a dispute arises.

We may update these terms from time to time. For any material change, we notify you at least 30 days in advance. Continued use of the platform after the update takes effect constitutes acceptance.
